1. GENERAL
1.1. Frilin.no is a website operated by Frilin Fashion AS (hereinafter referred to as "Frilin", "us" or "we"), a company registered in Norway with organization number 932 288 087 and located in
Kapellsanderveien 14 , 1400 Ski, Norway.
1.2. Frilin can be reached by email: hello@frilin.no if you have any questions about these terms and conditions, as well as matters related to orders and purchases.
1.3. These terms and conditions govern the terms of sale for all orders placed by the customer(s) (hereinafter referred to as "you" or "the customer") on the domain frilin.no, from the moment you place an order and until payment and delivery. By ordering a product, you agree to be legally bound by these terms and conditions.
Please make sure you have read and understood them before placing an order.
The Customer and Frilin are hereinafter referred to collectively as the "Parties".
1.4. Frilin reserves the right to change these terms and conditions from time to time. The new version will not be retroactive, and the parties shall only be bound by the Terms and Conditions that are online on the day the order is placed.
1.5. In these terms and conditions, the following terms shall have the meanings ascribed to them below:
- “Website” means the domain of frilin.no.
- “You” means the customer placing an order
- "Customer" means the person placing an order. Purchases made on the website are for private individuals only and not companies.
- “Working Day” or “Business Day” means a day that is neither (i) a Saturday nor a Sunday, nor (ii) a public holiday in the Customer’s country.
- “Order” means the order that you have submitted to the Website to purchase products from us.
- “Content” means all text, graphics, videos, images and all other information published on the Website.
-“Third-party websites” means all websites not provided by Frilin.
- “Contract” means the order you have placed for the purchase of Product(s) in accordance with these terms and conditions.
Words that represent the singular form shall include the plural and vice versa.
2. ORDER/CONTRACT FORMATION
2.1. You may only purchase products from us if you are legally capable of entering into a binding contract with us, you are an authorized user of the payment method used to pay for your order. You may not purchase Frilin products for commercial and/or business purposes.
2.2. Our website will guide you step by step to complete your purchase and place your order. You will be informed with a summary containing the essential information about your order before you make your purchase. We strongly recommend that you check all the details of your order before placing your purchase, as we cannot guarantee that we will be able to change the information afterwards.
2.3. Once you have placed your order, we will contact your payment provider immediately to authorize the payment from your account. We will not process your order until we have received such authorization.
2.4. Once payment has been approved, we will send you an email to confirm your purchase. This email is a confirmation of the purchase contract between you and us.
2.5. Frilin.no reserves the right to reject and/or block purchase requests from you for legitimate reasons, such as if we are unable to process your payment, if a product is/is out of stock or if Frilin suspects that you are purchasing products for commercial and/or business purposes. If a product is or becomes out of stock between the time you place an order and the time our warehouse processes it, we will cancel the purchase of the relevant product as it is no longer available. In such case, we will notify you and issue a refund. If for any reason we are unable to complete your order, you will receive an email with a cancellation. If payment has already been taken for such a cancelled order, we will refund the same amount using the same method used to make the payment. If for any reason alternative arrangements are necessary, Frilin will contact you.
3. PRICES AND PAYMENT
3.1. The prices stated on the Website apply to all orders placed through the Website. All prices are inclusive of VAT (where applicable). Shipping costs and other costs that may apply will be charged in addition and will be clearly displayed during the checkout process. Any costs for the package shall be paid by you (or a third party who obtains physical possession of the goods you have purchased).
3.2. Frilin has the right to change or update information at any time without notice, including errors with prices, details and descriptions displayed on the website.
3.3. If incorrect information is provided on a product you have purchased, please do not hesitate to contact our customer service under the terms of clause 1.3 of these Terms and Conditions.
3.4. We offer various payment methods. You will be able to find all the payment methods available in your country during the payment process.
Please note that we do not accept cash or checks.
3.5. All payments are subject to validation checks and approval by your chosen payment service provider. If the provider refuses or does not approve your payment for any reason, you will be notified via email and/or at checkout. Therefore, different terms and conditions may apply.
3.6. If the supplier refuses to approve payment for any reason, the order will be cancelled and you will then be notified via email and/or upon payment.
3.7. From time to time we may offer special offers and discounts relating to certain products on the Site. The terms and conditions of use in connection with any special offer or discount will be specified at the time of the offer.
3.8 We reserve the right to withdraw such special offers or discounts at any time, without prior notice.
3.9 Please note that you are responsible for all costs associated with money transactions.
4. SHIPPING AND DELIVERY
4.1. Shipping costs will be charged in addition to the purchase price of the product, and will be clearly displayed where applicable and included under "Total Cost" at checkout.
4.2. We aim to dispatch orders within two (2) to fourteen (14) working days of email confirmation. Please note that shipping times may be longer due to peak sales, unforeseen events or product availability with us and our suppliers.
4.3. We will perform a pre-authorisation check on the card used for purchase to ensure that there are sufficient funds to complete the transaction. The product you have purchased will not be dispatched until this check has been completed and payment has been received.
4.4. You will receive a confirmation email when your package has been shipped, indicating an estimated delivery time. The promised delivery time begins the moment you receive the confirmation email.
4.5. Depending on your location, you will be given delivery options. The delivery fee depends on the delivery option you choose. You will be able to find all the delivery methods available during the checkout process.
4.6. You must provide us with complete and accurate delivery address information, as we cannot guarantee that we will be able to change it after purchase. The customer is solely responsible for any delivery errors resulting from missing information or incorrect delivery address information at the time of placing the order. Risk and ownership shall pass to you when the products are in your possession.
4.7. Our carriers will do their utmost to deliver your order within the promised delivery time. However, delays are sometimes unavoidable. Please contact our customer service if you have not received your package within the promised delivery time.
4.8 Unless otherwise expressly agreed and if a delivery is delayed for more than 30 working days, you have the right to cancel the purchase.
4.9. If your package is delivered to a specific delivery location, you agree to collect the relevant package by the time specified in the delivery notification. Packages should normally be collected in person with valid identification and order number. If you do not collect your package on time, your order will be returned to us and refunded in full.
4.10. Our carriers do not deliver on weekends and public holidays. Please note that delivery of your order may take longer during sales or other busy periods.
5. RIGHT OF WITHDRAWAL, RETURN AND REFUND
5.1 We offer a 14 day return policy. Please note that you can only return products you have purchased through the website.
5.2 Returns
5.2.1. Without prejudice to your statutory right of withdrawal (see below), you may return products for any reason up to 14 days after you have received your order. It is best to use the return label provided with your order. Please contact customer service if you have lost the label.
5.2.2. Returns are accepted for discounted items, provided the product is in its original condition, unwashed and with all labels still attached. For hygiene and health reasons, we do not accept returns of unsealed underwear products.

5.2.4. Once your return reaches us and has been processed by us, we will issue a refund. The return process may take up to two (2) weeks from the time you send the product back. Once we have processed your return, you will receive an email with a credit note. You will then receive your refund within two (2) to five (5) business days.
5.2.5 If you wish to exchange an item, you must return the item and place a new order within five (5) days to avoid return shipping fees.
5.2.6 All refunds will be made using the same payment method you used to purchase the product. If you paid by invoice, your payment provider may need to contact you to issue a refund. We will refund the full amount of your order, including delivery costs. A return shipping fee will be automatically deducted from your refund using our enclosed return label.
5.3 Right to withdraw
5.3.1 You have the right to withdraw from a contract with us within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the goods you purchased.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement in writing. Cancel the order by contacting us by email: hello@frilin.no
To comply with the withdrawal period, it is sufficient that you send your communication about your use of the right of withdrawal before the withdrawal period has expired.
5.3.2 Consequences of withdrawal. If you withdraw from a contract with us and/or return any goods, we shall refund all payments we have received from you, including delivery charges for the order.
The refund shall be made without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to cancel or until we have received proof from you that the product has been sent, whichever is the earliest. You must return the goods you no longer want no later than 14 days from the day you receive the goods. We will refund using the same payment method that you used for the original transaction, unless you have expressly agreed otherwise. In the event of cancellation of the order, we will bear the costs of returning the goods, provided that you use the return label provided by us, otherwise you will have to pay the shipping costs for the return. We are allowed to reduce the refund to reflect the reduction in value of the goods, if this is caused by your handling, including any damage or loss that occurs during transport.
5.4 Fair Use Guidelines
While we pride ourselves on providing you with an outstanding customer experience, we take any violations and abuses of our return and exchange policies seriously.
Where appropriate and necessary, we investigate unusual return activities and take necessary action to achieve this. If we have reasonable evidence that you have systematically abused our return policy, We reserve the right to refuse all future purchase requests from you or to deactivate, temporarily or permanently remove any of your accounts.
If your account has been deactivated and you believe we have made a mistake, please contact customer service. The above provisions do not prevent you from returning/claiming items that have already been purchased.
6. LEGAL GUARANTEE OF CONFORMITY
6.1. If you find any defects in the goods you have purchased, Frilin complies with all statutory warranty provisions. You therefore have up to 3 years from the moment you receive the goods to claim legal warranty. Contact our customer service: hello@frilin.no
7. GIFT CARD
7.1. Payment and delivery.
7.1.1. Payment method. Frilin gift cards can only be purchased on the website with a credit/debit card.
7.1.2. Minimum and maximum value. Each purchase of a Frilin gift card is limited to a maximum value of 2000 NOK. The minimum value for a Frilin gift card is 250 NOK. You cannot increase the balance on the gift card once you have purchased it.
7.1.3. Delivery. Frilin gift cards will be delivered to the email address you provided at checkout.
7.2 Redemption.
7.2.1 Validity. Frilin gift cards are valid for 24 months from the date of purchase. After that, any remaining balance will be removed and the Frilin gift card will become invalid and no longer available for use.
Frilin gift cards can only be used on the website.
Frilin gift cards can be redeemed in combination with a discount code.
Frilin gift cards can be used until the balance on the card is zero. If the balance on a gift card reaches zero, the Frilin gift card is invalid and cannot be activated or used again.
7.2.2. Cannot be redeemed for cash. Frilin gift cards are not legal tender, account cards, credit or debit cards, or securities. You cannot get a cash advance with your Frilin gift card, redeem your gift card for cash, or receive any portion of the remaining value of the gift card in cash.
7.2.3. No exchange of gift cards. You cannot exchange your Frilin gift card for another denomination or type of gift card, or for cash or a discount. Frilin gift cards cannot be used to purchase another Frilin gift card.
7.2.4. Purchases exceeding the remaining value of the gift card. Frilin gift cards can only be used to make purchases up to the original value of the Frilin gift card or the remaining value of the Frilin gift card. If you wish to make a purchase for an amount exceeding the value of the Frilin gift card or the remaining value of the Frilin gift card, you must pay the excess amount with another payment method.
7.2.5. Lost/Stolen Gift Cards. Title and risk of loss of Frilin Gift Cards passes from us to you upon electronic transfer of the Frilin Gift Card. We are not obligated to replace lost or stolen Frilin Gift Cards, but you may report lost or stolen Gift Cards by contacting us.
7.3. Return of products purchased with a Frilin gift card and refund of gift cards
7.3.1. Returning goods purchased with a gift card. Products purchased in whole or in part with a Frilin gift card can be returned in accordance with our return policy .
7.3.2. Refund of Frilin gift cards. After you have returned the product(s) purchased in whole or in part with a gift card, your gift card will be credited.
If a partial refund is made for a purchase using a Frilin gift card and another payment method, any outstanding refund amount will first be credited to your debit/credit card. The remaining amount will then be credited to your Frilin gift card.
If the total amount to be refunded is higher than originally on the Frilin gift card, any remaining refund balance will be refunded to the other payment method.
7.3.3 Refund of Frilin gift cards. You have a return period of 14 days from the moment you receive the Frilin gift card to cancel your order for a Frilin gift card and receive a full refund. Gift cards that have been used cannot be refunded.
8. LIMITATION OF LIABILITY AND WARRANTIES
8.1. We make no warranties in relation to this website and the service or the information, materials and content made available. We do not warrant that the website will always be available or that the information on this website is true, non-misleading or accurate.
8.2. Information and content on the website should not be interpreted as Frilin providing advice of any kind.
8.3. You agree not to use any of our products for any commercial and/or business purposes and we disclaim any liability for any loss of revenue/profits, loss of contracts, loss of business, loss of opportunity or loss of reputation. Our maximum liability to you for any loss or damage arising in connection with your purchase on the Site shall be limited to the total price of your order.
9. TRADEMARKS
9.1. The trademarks, names and logos displayed on the website are registered and unregistered trademarks of Frilin and/or its partners. Prior consent from Frilin and/or its partners is required for the use of any trademark, image or video from the website. It is therefore strictly prohibited, in any way, to copy, reproduce, download, post, transmit or distribute documents originating from the website.
10. PRIVACY POLICY
10.1. Read our Privacy Policy which forms part of these terms and conditions.
11. CONDITIONAL CONFLICT
11.1 If there is a conflict or inconsistency between the provisions of these Terms and any other relevant terms and conditions, policies or notices, the other relevant terms and conditions, policies or notices that specifically relate to a particular part of Frilin will no longer be valid.
12. INVALID
12.1 If any provision of these terms and conditions is held to be invalid or unenforceable in any jurisdiction, court or authority, the remainder of the provision and all other provisions shall continue to apply.
13. LAWS AND DISPUTES
13.1 These terms and conditions shall be governed by and construed in accordance with Norwegian law.
13.2 Contracts entered into through the Website as well as any disputes that may arise based on or in connection with them shall be governed by Norwegian law. An amicable solution (through an ombudsman system) shall be considered before any legal remedies. In the event that this solution fails, the Norwegian courts shall exercise non-exclusive jurisdiction to resolve any disputes that may arise based on these terms.
13.3 The parties shall attempt to resolve any disputes amicably. If this is unsuccessful, the buyer may contact the Norwegian Consumer Authority for mediation. The Norwegian Consumer Authority is available by telephone at 23 400 600 or www.forbrukertilsynet.no .
The European Commission's complaint portal can also be used if you wish to file a complaint. This is particularly relevant if you are a consumer residing in another EU country. The complaint is filed here: http://ec.europa.eu/odr .
13.4 If a dispute or claim arises in connection with these terms, we will follow the decision of the Norwegian Consumer Authority, the Norwegian National Board for Consumer Complaints.
